1. GENERAL:

1.1 CleantechUV International Pty Ltd (here-after referred to as CTUV) conditions are intended for:

  • use of this website and
  • terms and conditions of sales and
  • supply of any services

2. SITE ACCESS CONDITIONS:

2.1 Your access to and the use of this site are governed by these terms and conditions. These terms and conditions also relate to goods or services purchased by the original purchaser.

2.2 When you visit our website, we give you a limited licence to access our information for personal use

2.3 You are permitted to download a copy of the information on this website to your computer for your personal us’ only, approved that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other manner infringes our intellectual property rights.

2.4 Except as permitted under the Copyright Act 1968, you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without the express permission of CTUV Management.

3. PRODUCT AND SERVICES:

3.1    Details of products, services and prices, if listed at this site, are indicative only and may not be current or complete.  We reserve the right to vary or modify our product and services catalogue and prices, and the information appearing at this site without notice. *Existing contracts and or agreements prior to any changes will not be affected

3.2    The appearance of a product or service listing at the site does not constitute an offer to sell the product or service to which the listing relates.  We do not guarantee product or service availability or the accuracy of prices listed on this site, and it is your responsibility to verify price and availability with your local distributor

3.3    CTUV does not make any warranty that goods or services promoted at this site will meet your specific requirements

3.4. Any quote for a product or service may be withdrawn at anytime until the Purchasers Order has been confirmed as accepted by CTUV

4. RETURNS:

4.1 CTUV is not obliged under the Australian Consumer Law (ACL) 2010 to give you a refund, replacement or arrange for a Manufacturers replacement or refund except where the ACL specifically details

5. WARRANTY:

5.1 CTUV provides to the original purchaser, that the goods and services supplied:

are solely for use as directed on specific surfaces and your person and that further RemUVe® treatments may be required dependent on the force and the use of the surface or your person of which the product is applied to

5.2 No warranties are given with the exception of those required by law. All implied warranties of merchantability or fitness for a particular purpose are expressly excluded.

6. Express Disclaimers:

6.1    Subject to the provisions of the Australian Consumer Law 2010 or other common, statute or Commonwealth laws, and to the fullest extent permitted by law, CTUV absolutely disclaims all warranties expressed or implied including – but not limited to – implied warranties of merchantability and fitness for any particular purpose.

6.2 CTUV gives no warranty that the products, information or services supplied will be free of errors or defects. Subject to your rights under the Australian Consumer Law, we exclude all implied terms and warranties whether statutory or otherwise, relating to this site or the subject matter of this agreement.  You acknowledge that this site is provided “as is” and that we do not make any warranty or representation as to the suitability of this site or any product or service for any purpose.

6.3    Subject to your rights under the Australian Consumer Law, we will not be liable to you for indirect and consequential loss (including without limitation for loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind) or loss or corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising from or connected to this agreement

6.4    Where any law implies in this agreement any term, and that law voids or prohibits provisions, which exclude or modify the operation of such term, then the term is taken to be included in this agreement.  However, our liability for breach of such term or any statutory guarantee conferred by legislation will be, if permitted by law (subject to ACL Section 68A), limited to one of the following remedies (at our option):
(i)    in the case of services: the resupply of the services; or the payment of the cost of resupply; and
(ii)    in the case of goods: the replacement of the goods, the supply of equivalent goods, the repair of the goods; the payment of the cost of replacing the goods (or of acquiring equivalent goods), or the payment of the cost of having the goods repaired.

6.5    Our liability to you for loss, damage, death or injury of any kind arising out of this agreement or in connection with the relationship established by it, is reduced to the extent (if any) that you cause or contribute to the loss or damage.

6.6    Nothing in these terms and conditions is intended to limit or exclude any liability that cannot be excluded by law or to the extent that any liability is caused or contributed to by our negligence.

7. LINKS to Other Website:

7.1 This site may contain links to third party websites that are not owned and operated by CTUV. These links are provided for your convenience only and:

we make no representations or warranties and have no responsibility or liability for those websites; and
these links do not indicate, expressly or implied, that we endorse those websites or any individuals, business, products or services that are promoted or provided at those websites.

7.2  We cannot guarantee any file, data or program available for download from this site (or any linked website) is free of viruses and you assume the risk of any damage to your computer or business as a result of using such site.

8. Termination:



8.1    We may immediately suspend, terminate or limit your access to and use of this site and (where relevant) your account if you breach these terms and conditions and further when: the breach cannot be remedied; or you fail to remedy the breach within 10 days of our notice to you of that breach; or If there is an emergency or we need to perform some maintenance on our site

9. GENERAL:

9.1    From time to time, business strategies change.  As such, we may in the future, stop making this site (or any part of it) available or close the site – where possible due notice will be posted on the site.

10.1 Under the ACL, our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure

11. AMENDMENTS:

11.1   We reserve the right to amend these terms and conditions from time to time.  Amendments will be effective immediately upon notification at this site.  Current contracts and confirmed agreements made and agreed to by CTUV and the original purchaser prior to any changes or amendments will not be affected. By continuing to use this site following such notification, you agree to be bound by the terms and conditions as amended

12.1 The technical data detailed on this web site is intended to provide a brief summary of our knowledge and guidance regarding the use of this material. 13. TRADEMARKS AND RESTRICTIONS OF USE:

13.1 You are not permitted to use any trademarks, trade names, graphics or designs that are on this website. If you breach any CTUV trademarks, then CTUV reserves the right to take any relevant action against you

14.1 All prices indicated are in Australian dollars (A$) and will indicate if GST is included or not. Generally, GST is included unless otherwise indicated.
